Please note: Miracle-Gro® Lawn care products are NOT included. Miracle-Gro® All Purpose is the only compost that is included in this promotion, Miracle-Gro® Multipurpose Compost is NOT included.
How the Performance Guarantee works
The following Terms and Conditions (the “Guarantee”) govern the operation of the Performance or Money-Back Guarantee offered by Evergreen Garden Care (the “Company”) for eligible products, as listed on the Scope included on the website, specifically, a list of Compost and Plant Food (the “Products”).
By submitting a claim under this Guarantee, the Customer acknowledges and agrees to be bound by these Guarantee Terms, which shall be read in conjunction with the Company's General Terms of Sale. This Guarantee is provided in addition to, and does not affect, the Customer's statutory rights.
1: Defined terms
1.1: Compensation: The maximum remedy provided under this Guarantee, strictly limited to the verified purchase value of the eligible Product, subject to the conditions set out in these Terms and Conditions, and the verification of both purchase and performance failure.
1.2: Customer: The individual purchasing and claiming under the Guarantee.
1.3: Products: Compost and Plant Food, as listed under Scope.
1.4: RRP: Recommended Retail Price.
1.5: Reasonable Care: Defined in Section 5.1.
2: General Guarantee conditions and eligibility
2.1: The Guarantee covers for personal customer experience only, not growing for commercial or community projects.
2.2: The Guarantee is valid for one calendar year (12 months) from the date of purchase.
2.3: This Guarantee is strictly limited to the verified performance failure of the Product itself. It does not extend to, nor shall compensation be offered for, the cost of replacing the plant or any costs associated with its failure to thrive. Performance is assessed solely based on the claims on pack regarding demonstrable characteristics such as size, floral output, and foliage colour.
2.4: Plants that show any signs of pests or disease will be excluded, as this is completely beyond our control. We recommend you consult the grower/retailer.
2.5: Compensation under this Guarantee shall be limited to the Miracle-Gro & HTA National Garden Scheme voucher. The value of the vouchers shall not exceed the lesser of (i) the verified purchase value of the Product (excluding shipping and taxes) or (ii) the equivalent RRP cost of 100L of Compost (where applicable). The provision of a valid receipt or other verifiable proof of purchase is mandatory to determine the compensation amount.
2.6: This Guarantee excludes employees of the Company, their immediate family members, retail partners, and affiliated agencies.
3: Growing media specific conditions
3.1: The guarantee for the All Purpose Compost is strictly limited up to a maximum of 100L of compost per person, per calendar year (12 months).
3.2: The Customer is required to follow the guidance on the Product packaging and maintain Reasonable Care of the plant for a minimum duration of three (3) months.
3.3: If, after the minimum three-month Care Period, the plant is not considered healthy, the claim will be assessed by the Company based on photographic evidence versus the claims on pack. Assessment shall be based upon scientific data.
3.4: If you notice any issues after six weeks, please reach out to the Miracle-Gro Garden Gurus for guidance.
3.5: Territory: This guarantee applies solely within Great Britain (GB) and explicitly excludes Northern Ireland (NI) and the Republic of Ireland (ROI).
4: Plant food - specific conditions
4.1: The offer is limited up to one (1) pack of Plant Food per Customer in a calendar year. The same batch code cannot be claimed against in a subsequent year.
4.2: The Customer is required to follow the guidance on the Product packaging and maintain Reasonable Care of the plant over the duration quoted on the Product packaging, and for a minimum of one (1) month prior to assessment.
4.3: If you notice any issues whilst using the product, please reach out to the Miracle-Gro Garden Gurus for guidance.
4.4: Territory: This guarantee applies within Great Britain (GB), Northern Ireland (NI) and the Republic of Ireland (ROI).
5: Claims process and proof requirements
5.1: Reasonable Care Definition: Reasonable Care entails, without limitation: (i) Regular watering (avoiding underwatering or overwatering); (ii) Feeding as recommended (avoiding over or underfeeding); and (iii) Confirmation that the plant was free from fungal disease and pests prior to application, as signs of these indicate an unhealthy plant not caused by the Product. The Company reserves the right to request additional documentation (such as a watering or feeding log) to ensure that Reasonable Care was maintained.
5.2: Proof of Purchase and Use: The Customer is required to provide: (i) Valid proof of purchase (receipt); (ii) Clear photographic evidence of the Product packaging visible near the application area; and (iii) For Plant Food, clear ‘before and after’ photographic evidence, along with proof the Product was used as specified (e.g., dilution or application method). (iv) For Compost, clear ‘before and after’ photographic evidence, along with proof the Product was used as specified (e.g., for all plants except as recommended on pack, seeds and ericaceous plants). The Company reserves the right to reject any claim where evidence is deemed insufficient, unverifiable, or fraudulent.
5.3: Claim Submission and Response: All claims must be submitted using the official claim form provided via the link below. Upon submission of a complete claim, the Company's designated assessor (“Miracle-Gro Garden Guru’s”) shall respond to the Customer within a period of fourteen (14) to twenty-eight (28) working days.
6: Data protection
The Customer's personal data shall be processed solely for the purpose of handling the claim, in accordance with the Company's Privacy Policy. Claim details shall be retained for a period of three (3) years from the date of submission. The Customer retains the right to access, rectify, or request deletion of their data at any time by contacting Customer Care line email.
